Overview

This website is operated by RMS International UK Ltd, trading as abeec Toys, a company registered in England and Wales under company number 01161241. Registered office: Grafix House, 6 Boundary Road, Pendlebury, Swinton, Manchester, M27 4EQ. VAT number: GB 588863858. Throughout the site, "we", "us" and "our" refer to RMS International UK Ltd trading as abeec Toys.

We offer this website, including all information, tools, products, and services available from it (the "Service"), to you on condition that you accept these Terms of Service, together with the policies referenced in them, including our Privacy Policy, Cookies page, and Returns Policy.

By visiting our site or purchasing something from us, you agree to be bound by these Terms. Please read them carefully before using the site. If you do not agree to them, please do not use the site or the Service.

Any new features or tools added to the store are also subject to these Terms. We may update these Terms from time to time by posting changes on this page. Your continued use of the site after changes are posted means you accept the updated Terms. Nothing in these Terms affects your statutory rights as a consumer.

Our store is hosted on Shopify, which provides the ecommerce platform that allows us to sell our products to you.

Section 1 - Online store terms

By agreeing to these Terms, you confirm that you are at least 18 years old. Our products are made for children, but all purchases must be made by an adult. If you allow a child to use this site, you are responsible for their use of it.

You may not use our products or the Service for any illegal or unauthorised purpose, or in a way that breaks any law in your jurisdiction, including copyright law. You must not transmit any viruses, worms, or code of a destructive nature. A breach of these Terms may result in immediate termination of your access to the Service.

Section 2 - General conditions

We reserve the right to refuse service to anyone for any lawful reason at any time.

You understand that your content (not including payment card information) may be transferred unencrypted across various networks and adapted to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without our express written permission.

Headings in these Terms are for convenience only and do not affect their meaning.

Section 3 - Accuracy of information

We work hard to keep the information on this site accurate, but we cannot promise it is always complete or current. The material on this site is provided for general information only. This site may contain historical information, which is provided for reference only. We may change the content of this site at any time, but we have no obligation to update it.

This section does not limit your legal rights in relation to products you buy from us, including your right under the Consumer Rights Act 2015 to receive goods that match their description.

Section 4 - Ordering, prices, and our contract with you

When you place an order, you will receive an email confirming we have received it. This email is not acceptance of your order. Our contract with you is formed when we send you confirmation that your order has been dispatched. If we cannot accept your order, for example because a product is out of stock or there has been a pricing error, we will let you know and refund any payment taken.

Prices for our products may change without notice. All prices include VAT where applicable. We may modify or discontinue the Service, or any part of it, at any time. Discount codes, whether advertised on our website, in marketing communications, or through third-party partners, cannot be used against reduced prices unless we explicitly say so.

Section 5 - Products

Certain products may be available exclusively online and may have limited quantities. Returns and exchanges are handled according to our Returns Policy and your statutory rights.

We have made every effort to display the colours and images of our products accurately, but we cannot guarantee that your screen will show colours exactly as they are.

We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, and to limit the quantities of any product we offer. Product descriptions and pricing may change at any time. We may discontinue any product at any time.

If you are buying as a consumer, you have legal rights in relation to products that are faulty, not as described, or not fit for purpose. Nothing in these Terms affects those rights.

Section 6 - Billing and account information

We reserve the right to refuse or cancel any order. We may limit or cancel quantities purchased per person, per household, or per order, including orders that appear to be placed by dealers, resellers, or distributors. If we change or cancel an order, we will try to contact you using the details you provided when ordering.

You agree to provide current, complete, and accurate purchase and account information, and to keep it up to date so we can complete your transactions and contact you when needed.

For returns and refunds, please see our Returns Policy.

Section 7 - Your right to cancel

If you are a consumer in the UK, you have the right under the Consumer Contracts Regulations 2013 to cancel your order for any reason within 14 days of receiving your goods. To cancel, contact us using the details at the end of these Terms within that period, then return the goods to us within 14 days of telling us. We will refund you within 14 days of receiving the goods back, or of you providing proof of return. We may reduce your refund if the value of the goods has been reduced by handling beyond what is needed to inspect them. This right is in addition to anything in our Returns Policy and does not affect your statutory rights if goods are faulty.

Section 8 - Optional tools and third-party links

We may give you access to third-party tools that we do not monitor or control. We provide access to these tools as is and as available, without warranties of any kind, and we accept no liability arising from your use of them. Use of optional tools is at your own risk, and you should make sure you are familiar with the terms of the relevant third-party provider.

Content, products, and services available through the Service may include materials from third parties, and links on this site may take you to third-party websites that are not affiliated with us. We are not responsible for the content or accuracy of third-party websites, and we are not liable for any harm or damages related to purchases or transactions made on them. Please review the third party's policies before you transact with them, and direct any complaints or questions about third-party products to the third party.

Section 9 - User comments, feedback, and other submissions

If you send us submissions, whether we asked for them (for example contest entries) or not (for example creative ideas, suggestions, or proposals), you agree that we may edit, copy, publish, distribute, translate, and otherwise use them in any medium without restriction. We are under no obligation to keep any comments confidential, pay compensation for them, or respond to them.

We may, but have no obligation to, monitor, edit, or remove content that we determine is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You agree that your comments will not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights, and will not contain unlawful, abusive, or obscene material, or any malware. You may not use a false email address or pretend to be someone else. You are solely responsible for the comments you make and their accuracy.

Section 10 - Personal information

Your submission of personal information through the store is governed by our Privacy Policy, which you can read at https://www.abeectoys.com/policies/privacy-policy

Section 11 - Errors, inaccuracies, and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or update information, or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order. If we cancel an order for this reason, we will refund any payment taken.

Section 12 - Prohibited uses

In addition to the other prohibitions in these Terms, you must not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any laws or regulations; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate, or discriminate against anyone; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of these prohibitions.

Section 13 - Our liability to you

If you are a consumer, nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, breach of your statutory rights under the Consumer Rights Act 2015, including the right to receive goods that are of satisfactory quality, fit for purpose, and as described, or any other liability that cannot be excluded or limited under UK law.

Subject to the above, we do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error free, and we may withdraw the Service at any time. We are not liable for losses that were not foreseeable when you used the site or placed your order, losses that were not caused by our breach, or business losses, including lost profits, lost revenue, or loss of data, where you use the site or our products for business purposes.

If you are a business user, the Service and all products are provided as is and as available, and to the fullest extent permitted by law we exclude all implied warranties, conditions, and terms, and our total liability to you is limited to the amount you paid for the products giving rise to the claim.

Section 14 - Indemnification

If you are a business user, you agree to indemnify and hold harmless RMS International UK Ltd and our affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party. This section does not apply to consumers.

Section 15 - Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder will be severed. The validity of the remaining provisions will not be affected.

Section 16 - Termination

These Terms are effective unless and until terminated by you or us. You may stop using our Service at any time. We may terminate this agreement without notice if we believe you have failed to comply with any part of these Terms, and you will remain liable for all amounts due up to the date of termination. Obligations and liabilities incurred before termination survive it.

Section 17 - Entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and the policies posted on this site make up the entire agreement between you and us regarding your use of the Service, and supersede any prior agreements or communications. Nothing in this section limits or excludes any liability for fraud or affects your statutory rights.

Section 18 - Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, you can bring proceedings in the courts of England and Wales, and if you live in Scotland or Northern Ireland you can also bring proceedings in your local courts. You also benefit from any mandatory consumer protections of the country you live in.

Section 19 - Changes to these Terms

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. Your continued use of the site after changes are posted means you accept them.

Section 20 - Contact information

Questions about these Terms should be sent to us at hello@abeectoys.com or by post to RMS International UK Ltd, Grafix House, 6 Boundary Road, Swinton, Manchester, M27 4EQ, United Kingdom.

If you have a complaint we cannot resolve, you may be able to use alternative dispute resolution. This does not affect your right to bring a claim in court.
